T-Mobile USA in $2.4 billion tower deal with Crown Castle

NEW YORK (Reuters) - T-Mobile USA is selling the rights to operate 7,200 of its wireless broadcast towers for $2.4 billion to Crown Castle International Corp to help fund a network upgrade and reduce debt at its parent Deutsche Telekom.

Crown Castle has the option to pay another $2.4 billion to buy the towers outright from T-Mobile USA at the end of the lease term for each tower - between 2025 and 2048 - under the deal announced on Friday.

Analysts said it was a good deal for T-Mobile USA, which is spending $4 billion on a network upgrade. They noted that the company has also been looking to become more financially independent from its parent, which had tried to exit the U.S. market the year before.

However, several analysts said that Crown Castle had over-paid, likely because another bidder had pushed up the price.

Evercore Partners analyst Jonathan Schildkraut said the company paid about $400 million more than he would have liked.

"As people start to pull apart the numbers, it doesn't look that great," Schildkraut said, but he added that Crown Castle "needed to do it for growth."

Deutsche Telekom said the deal would reduce its debt by about $2.4 billion or roughly 1.9 billion euros.

T-Mobile USA, the No. 4 U.S. mobile provider, has been struggling to stem customer losses as it has a tough time competing with bigger and smaller rivals.

It had been trying to raise money from a tower sale since its proposed purchase by AT&T Inc failed late last year because of regulatory opposition. It had also looked into selling the towers in early 2011 before it started the AT&T process.

The deal is expected to close in the fourth quarter, according to the companies.

ROOM TO GROW

Crown Castle said it expects the towers to generate about $125 million to $130 million in adjusted funds from operations before financing costs in 2013.

JPMorgan analyst Phil Cusick said that while the price tag was at the high end of his expectations, it was mitigated by Crown Castle's strong growth outlook for the assets.

Crown Castle said the towers will have enough space to accommodate at least one additional wireless service provider customer on each tower, which would increase the leasing revenue it would receive without significant incremental capital.

As part of the deal, T-Mobile USA committed to maintaining its facilities on the towers for at least 10 years with annual rent increase provisions tied to the consumer price index. T-Mobile USA's rent includes the rights to complete its network upgrade on these sites.

"The deal is well structured to account for the inherent risks of purchasing a tower portfolio highly weighted to one carrier," Piper Jaffray analyst Christopher Larsen said.

Deutsche Telekom said the company had multiple bidders for the assets, but declined to name them.

Analysts have said other companies that considered the towers included American Tower Corp and SBA Communications Corp.

Crown Castle shares fell 23 cents to $64.68 on the New York Stock Exchange after the news, while Deutsche Telekom shares closed down 1.6 percent in Frankfurt.

Voter registration problems widening in Florida

(AP) ? What first appeared to be an isolated problem in one Florida county has now spread statewide, with election officials in at least seven counties informing prosecutors or state election officials about questionable voter registration forms filled out on behalf of the Republican Party of Florida.

State Republican officials already have fired the vendor it had hired to register voters, and on Thursday took the additional step of filing an election fraud complaint against the company, Strategic Allied Consulting, with state officials.

A spokesman for Florida's GOP said the matter was being treated very seriously.

"We are doing what we can to find out how broad the scope is," said Brian Burgess, the spokesman.

Florida is the battleground state where past election problems led to the chaotic recount that followed the 2000 presidential election.

The Florida state party has paid Strategic Allied Consulting more than $1.3 million, and the Republican National Committee used the group for nearly $3 million of work in Nevada, North Carolina, Colorado and Virginia.

The company said earlier this week that it was cooperating with elections officials in Florida. It said the suspect forms were turned in by one person, who has been fired.

"Strategic has a zero-tolerance policy for breaking the law," Fred Petti, a company attorney, said Thursday.

An email request to the company seeking additional comment, following the company's instructions, was not immediately returned Friday.

In Florida, it is a third-degree felony to "willfully submit" any false voter registration information, a crime punishable by up to five years in prison.

The questionable forms have showed up in South Florida, including Miami-Dade, as well as northeast Florida and the Florida Panhandle.

Election officials in Escambia and Santa Rosa counties on Thursday handed over more than 100 suspect forms to local prosecutors. They did so days after officials in Palm Beach County also alerted prosecutors.

Ann Bodenstein, the elections supervisor for Santa Rosa County, said her staff started raising questions after an employee saw a form that changed the home address of a neighbor.

Paul Lux, election supervisor for Okaloosa County, said questionable forms in the Florida Panhandle appear to have all come from Strategic's effort based at the local Republican Party headquarters. He said his office has turned up dozens of suspect forms.

Lux said there have been forms that listed dead people and were either incomplete or illegible. He met with local prosecutors on Friday, but added that his staff was still going through hundreds of forms dropped off by Strategic employees.

Lux, who is a Republican, said he warned local party officials earlier this month when he first learned the company was paying people to register voters.

"I told them 'This is not going to end well,'" Lux said.

But Lux added that he did not blame the Republican Party of Florida.

"I can't place the blame on RPOF if they hired a firm and that firm wasn't following the rules they were given to follow," Lux said.

Lux also heard a complaint from the head of the local chapter of the League of Women Voters, who raised questions about Strategic employees.

Mary Blackwell said the league's Okaloosa County chapter held a voter registration drive at a college campus in Niceville and that a person who was registering voters told her he was "lucky" he only had applications from Republicans or independents. Blackwell said she was "distressed" by the comments and became worried that he may be discarding voter registration forms filled out by Democrats.

The state party filed the complaint against Strategic Allied Consulting with state election officials, who can refer the case to the Florida Department of Law Enforcement if it is found legally sufficient.

HK tycoon offers $65M dowry for gay daughter

HONG KONG (AP) ? The daughter of a flamboyant Hong Kong tycoon who has offered $65 million to any man who can woo her away from her lesbian partner said she's not upset with her father. Still, it's unlikely she will be accepting any of the marriage proposals flooding in.

Cecil Chao made world headlines this week when he offered the 500 million Hong Kong dollar marriage bounty after learning that his daughter, Gigi Chao, had eloped with her partner to France.

"I'm actually on very, very loving terms with my father. We speak on a daily basis. He just has a very interesting way of expressing his fatherly love," the 33-year-old told The Associated Press.

She said her father offered the reward because he was upset after learning she had "a church blessing in Paris" with her girlfriend of the past several years.

"What this whole episode really highlights is that perhaps still, the Chinese ? or in fact the Hong Kong mentality ? can perhaps tolerate the 'don't ask, don't tell' view of sexuality," she said. "But as a social statement, it's still very much a sensitive issue."

Hong Kong decriminalized homosexuality in 1991, but it does not legally recognize same-sex marriage.

Cecil Chao is the chairman of Hong Kong property developer Cheuk Nang Holdings and has a reputation for being a playboy. He once claimed to have had 10,000 girlfriends but has never married. He's also known for his love of Rolls-Royces and for being a qualified helicopter pilot, a skill he shares with Gigi Chao, one of his three children by three different women.

Cecil Chao said Friday in a separate interview with the AP that reports that his daughter had married were just rumors. He added that he has received hundreds of offers from suitors since he made the offer and his daughter has probably had thousands.

"I was very surprised about the reaction from around the world," said the 76-year-old tycoon, sporting gold mirrored sunglasses and a sport jacket over an unbuttoned polo shirt. "Thousands of people writing to say they want to be my in-laws."

He said he's offering the money because he wants to make sure his daughter has a comfortable life in Hong Kong, which he believes will require a house worth HK$150 million ($19 million). The rest of the money can be used for investments, he said.

"Living a comfortable life in Hong Kong, not super-luxury, takes HK$500 million," he said.

When asked whether she would accept an eligible suitor, Gigi Chao laughed off the question, saying, "We'll just worry about that when the time comes."

Yankees shut out, AL East lead down to 1 game

Associated Press Sports

updated 10:14 p.m. ET Sept. 27, 2012

TORONTO (AP) - Ivan Nova didn't do much to help his case for a spot in the Yankees' potential playoff rotation. If anything, he made New York's path to the postseason a little tougher.

Brandon Morrow and two relievers combined on a five-hitter, pitching the Toronto Blue Jays to a 6-0 victory over Nova and the Yankees on Thursday night that trimmed New York's lead in the tight AL East.

Edwin Encarnacion had three hits and three RBIs. Brett Lawrie hit a two-run homer and J.P. Arencibia added a solo shot as the Blue Jays handed an assist to idle Baltimore, shaving New York's division lead over the Orioles to one game.

The Yankees lost for the third time in five games and wasted a chance to go two up with six to play.

"We know what's at stake right now and we've just got to go out there and keep picking up wins," Nick Swisher said. "We've got a little six-game playoff race."

Making his third start since missing 14 games with a sore right shoulder, Nova (12-8) allowed four runs and six hits in 4 2-3 innings. He walked two and struck out four.

"I'm not pitching the way I want and I'm not getting the result I want, so that's not good," Nova said.

Knocked out in the third inning of his previous start, Nova has not won back-to-back outings since a five-start winning streak from May 25 to June 17. The 87 extra-base hits off him are the most yielded by any big league pitcher.

"He just hasn't had the command, that's the bottom line," manager Joe Girardi said.

Nova insisted he's not worried about his future in New York's rotation, but acknowledged his struggles are starting to wear on him.

"Especially right now, the position we're in, I'm not feeling good about it," he said. "We want to win every day and I'm not doing that."

Morrow (9-7) scattered four hits over seven innings, walked three and struck out three to win for the first time in five starts.

Swisher said Morrow kept the Yankees off balance with an assortment of off-speed pitches, not just a blazing fastball.

"It didn't seem like he was really raring back tonight," Swisher said. "It felt like he was pitching. He was throwing a lot more cutters than I remember, a lot more changeups, breaking balls, things like that, rather than that flat 96 (mph). He did a good job."

Yankees catcher Russell Martin said Morrow was aggressive in the strike zone.

"Every time you're in there it feels like you're behind in the count," Martin said.

It was Morrow's longest outing since returning from the disabled list Aug. 25 after missing 65 games with a strained muscle in his left side.

"You always want to try and finish up strong," Morrow said. "It takes a little while to get back into a groove (after an injury) but I've felt good the whole time."

Brad Lincoln worked the eighth and Darren Oliver finished for the Blue Jays, who have won three of four following a seven-game losing streak.

Morrow got some help from his defense after Robinson Cano's one-out single in the fourth. Rookie left fielder Anthony Gose crashed into the wall to haul in a deep drive from Swisher, then threw the ball into second baseman Kelly Johnson, who doubled off Cano at first.

"(Cano) probably got a little bit too far, but it's a great play by Gose," Girardi said.

Cano doubled to begin the seventh and Swisher walked but Morrow fanned Curtis Granderson, then got Martin and Raul Ibanez to fly out.

Nova ran into trouble after walking Gose to begin the fourth. Lawrie followed with an opposite-field homer to right, his 10th of the season and first since July 22.

Gose led off with a single in the fifth, went to second on Lawrie's groundout and moved to third on a bunt single by Colby Rasmus. That brought up Encarnacion, who drove in both runners with a double into the right-field corner.

Even with the infield drawn in, New York couldn't stop Toronto from making it 5-0 against Derek Lowe in the seventh when Lawrie scored on Encarnacion's grounder to shortstop. Arencibia capped the scoring with a second-deck homer off David Aardsma in the eighth, his 18th.

Blue Jays shortstop Yunel Escobar was greeted with a smattering of boos during his first home game since wearing eye-black with an anti-gay slur. A few fans booed when Escobar's name was announced as the lineups were read before the game. There was a mix of boos and cheers as Escobar batted in the bottom of the first, lining out on Nova's first pitch.

"The three years I've been here in Toronto the fans have been great to me," Escobar said through a translator. "They know how hard I work and I give everything on the field. I made a mistake. I'm sorry for it."

Escobar's subsequent at-bats drew almost no reaction from the crowd of 23,060.

NOTES: New York OF Brett Gardner, who came off the 60-day DL this week after missing 142 games with a strained right elbow, took part in two sets of batting practice before the game. It's the first time he's taken BP since rejoining the team. ... Yankees 3B Alex Rodriguez, who did not play in Wednesday's victory at Minnesota, started at DH. Jayson Nix was at third base. Girardi said Rodriguez could return to third base during this series, possibly Friday. Rodriguez went 0 for 2 and has one hit in his last 16 at-bats. ... New York 1B Mark Teixeira (strained left calf) had seven at-bats in a simulated game and will do the same Friday or Saturday, Girardi said. ... Aardsma pitched in a major league game for the first time since Sept. 19, 2010. He missed the past two seasons following hip and elbow operations.

Mr. Sexy Back tries to bring Myspace back

NEW YORK (AP) ? "Who am I to say I want you back? When you were never mine to give away."

Those are the opening lines of a song that accompanies a "New Myspace" promotional video. The once-mighty social network is trying to stage yet another comeback with the help of Justin Timberlake. The new site, for which people can request an invitation, looks a bit like an entertainment-focused version of Pinterest, with a dash of Twitter and Facebook thrown in.

But Myspace has tried redesigns before, to no avail. Will it work this time?

"If you break my heart a second time, I might never be the same," continues the song, "Heartbeat," by the group JJAMZ.

From the sound if it, Myspace wants to win the hearts and minds of tech-savvy hipsters. Founded in 2003 and initially a fast-rising star, Myspace attracted mostly teenagers and twentysomethings, offering them a place to express themselves online. It peaked in 2008 with some 76 million U.S. visitors in October. The site lost its footing as the fun of customizing profile pages began to bore its users and the site's heavy use of banner advertisements slowed the speed at which pages loaded. At the same time, people were already migrating to Facebook, which counted users 35 and older among its fastest-growing demographic.

The company's new promotional video offers a 2-minute and 18-second peek into a slick, image-heavy site. The site's much cleaner look is a stark contrast to the old Myspace, which users often derided as messy and cluttered. Posted this week, the video promises that Myspace will start "totally from scratch," as if trying to shed its former self. It doesn't say when the new site will launch, only that it's "not ready quite yet."

The new Myspace will let users connect to the site with their Twitter or Facebook accounts, a sign that it won't be competing with those sites as a social networking service. Rather, Myspace will continue with its entertainment focus, as a place to play and discover music, add photos, videos and playlists and connect with artists.

Timberlake, who's featured prominently in the video, will likely play a big part of the MySpace revamp. The former 'N Sync pop star, with a group of other investors, bought MySpace last summer from News Corp. for $35 million, mostly in stock. That was quite a difference from the $580 million that News Corp. paid for the company in 2005, when it was still an Internet darling.

MySpace, of course, isn't Timberlake's first foray into social networking. He played Napster co-founder Sean Parker, a party animal and early Facebook adviser, in Aaron Sorkin's "The Social Network" in 2010.

In August this year, research firm comScore put Myspace's monthly unique visitors at 28 million, making it the 43rd most visited Web property in the U.S. It's behind the likes of not just Google, Facebook and Twitter but startups such as Tumblr, along with the reviews site Yelp and WebMD.

"The new design certainly looks beautiful and it could certainly spur a lot of initial interest," said Clark Fredericksen, spokesman for research firm eMarketer, which used to put out ad revenue estimates for MySpace but no longer does. "But there are going to be significant challenges for any company looking to enter the digital music space. You have a lot of entrenched players who are really successful."

Those players include Spotify, Pandora, Rdio, not to mention Apple Inc.'s iTunes.

There's also the mobile question. It's unclear from the video what plans the new MySpace has for mobile devices such as Android smartphones, iPhones and tablet computers. Fredricksen points out that cloud-based music ? streamed over an Internet connection ? is shifting toward the mobile platform primarily. We are all on the go with our music. MySpace is entering a crowded market here, too.

Representatives for Specific Media, which owns Myspace, did not return messages for comment Wednesday. Timberlake's publicist also did not return an email for comment. With only the slick demo and the poppy, bittersweet lyrics of the JJAMZ song to offer details about the "New Myspace", these lines stand out:

"Maybe I'm ashamed to want you back. Maybe I'm afraid, you'll never stay."

FOR KIDS: Pathways to research: Connecting with scientists

Budding researchers get ahead by spending their free time working side by side with real scientists

Web edition : Tuesday, September 25th, 2012

Not many scientists begin their careers with a busted knee. But that?s exactly how Evan Olin, now 18, got his start. While a freshman at Ossining High School in New York, this competitive runner ran so fast and so hard that he sustained serious injuries to both legs. It kept him off the track for months. Rather than becoming discouraged by his limping gait, however, Olin turned to science. He started exploring how intense activities ? like his long jogs ? could harm the human body.

The summer before his sophomore year, Olin landed a spot working in the lab of Gregory Gutierrez at New York University. Gutierrez studies how human joints develop and function. Eventually Olin started plopping experienced joggers onto treadmills to see how they ran when forced to jog barefoot ? a type of running that?s become popular among exercise fiends.

He and other students profiled here show how even high school students can begin to participate in interesting and important research.

Green Tea ? Why Drink It? | Life-Health-Happiness

In Asia, green tea is quite popular. For many generations, the tea has already been a part of family gatherings and even their day to day lives. There are various reasons why Asian people loved to drink green tea. Aside from its excellent taste, you can also derive some health benefits from drinking green tea. Recently, medical communities and the western countries have recognized the benefits of drinking green tea. There are various reasons why individuals should drink tea and these reasons are found in this article.

The very first reason is that green tea is something different. You?re probably used to drinking softdrinks, coffee, fruit juices, and other beverages. Green tea is something new that you should try out. It?s not everyday that you get to encounter something unique in terms of taste and most specially, very few beverages have health benefits.

Most Americans drink coffee several times a day and since it contains a larger amount of caffeine, some people are already looking into substituting green tea instead. You will surely enjoy the tea?s nutty aroma and its sweet grassy flavor. Although some studies show that green tea also has caffeine, there are now decaffeinated green tea sold in the market.

Still, if you want to go for the traditional green tea, it would help to know that the caffeine content is lesser as compared to coffee. Some people get jitters and you can avoid this by taking green tea in moderate amounts. Those who plan to stay late or those who work at night should drink green tea instead of coffee to help them stay awake.

The second reason why people should drink tea is that it contains healing properties. Because of today?s advanced science, many medical experts are discovering green tea?s healing properties. Green tea is mainly made up of antioxidants which can help in improving the overall health of an individual. If you lack energy to carry out the day?s tasks and chores, don?t forget to drink your tea because you will feel a burst of energy especially if you drink it everyday.

Healthy cells are also promoted by drinking tea. There are still other health benefits that you can take advantage. You see, if you drink green tea, you can prevent heart diseases, cancer, and other health problems. Those who often get sick should take tea in order to boost the immune system?s health. People with weight problems can also take green tea instead of water and juices to reduce weight since the tea can suppress appetite. You can take it anytime you like, before meals, during, and after meals.

Are there still other reasons that you can think of? So far, there is no other beverage that can give you a lot of health benefits. If you go to the groceries, you can find different kinds of green tea preparations. It would be best if you can grow a tea plant so that you can prepare the original serving. But anyway, since people today live a busy lifestyle, they always prefer the instant ? from food to their drinks. There are now bottled green tea which you can purchase and they are ready to drink. Hurry and go to the local grocery now to purchse your green tea.

If you want, you can also take supplements of green tea but before you buy any, ask your doctor first. It would also be good if you check product reviews regarding the supplements. That way, you will know which brands sell more and which are effective. Seek the doctor?s advice before taking any health supplement so that your actions can be guided, most especially if you?re a pregnant woman or if you have certain allergies and illnesses.

If the Asian people benefited from green tea for hundreds of years, then there?s probably no reason why you shouldn?t try it yourself. Medical communities are already promoting the intake of green tea, so don?t be left behind. Join other people who are now discovering the health benefits of drinking tea.

With a lockout drawing ever closer, the NHL and the players' union are in touch with each other after a day of internal meetings. But no new negotiating sessions are scheduled for Friday, one day before Commissioner Gary Bettman has said he will lock out the players. This would be the NHL's fourth work stoppage since 1992.(AP Photo/J Pat Carter)

(AP) ? The NHL said there will be no bargaining with the players' union Saturday, leaving nothing to stop a lockout.

This will be the league's fourth work stoppage since 1992, and this latest action adds to a landscape of labor unrest across American professional sports. The lockout will be the third to hit a major sports league in 18 months, following ones in the NFL and the NBA.

NHL deputy commissioner Bill Daly told The Associated Press in an email that the sides have spoken by telephone, but there will be "no formal bargaining" before the midnight deadline. He had conferred with players' association special counsel Steve Fehr, the brother of NHLPA executive director Donald Fehr, to see if there would be face-to-face talks.

This was the third straight day the sides spoke by phone but avoided the negotiating table.

"Today we suggested that the parties meet in advance of the owners' self-imposed deadline of midnight tonight," Steve Fehr said Saturday in an emailed statement to the AP. "Don Fehr, myself and several players on the Negotiating Committee were in the city and prepared to meet. The NHL said that it saw no purpose in having a formal meeting.

"There have been and continue to be private, informal discussions between representatives of both sides."

For nearly a year, NHL Commissioner Gary Bettman has said he would lock out players if a collective bargaining agreement wasn't set by the time the current one expires.

It now appears unlikely that training camps will open next week. The regular season had been scheduled to begin Oct. 11, but that is also in peril.

"There's a lot of stuff that still needs to be sorted out. Hopefully things will heat up in the next couple of weeks," said forward Milan Lucic, who agreed to a three-year extension with the Boston Bruins on Saturday that will pay him an average of $6 million annually. "There's obviously a little bit of concern, but right now all you can do is stay optimistic and stay positive and hope that a deal will get done."

All four of the major leagues in the United States ? football, basketball, baseball and hockey ? have gone through labor negotiations within the past couple of years. Both the NFL and NBA went into lockouts, and though the NFL missed no regular-season games, the 2011-12 NBA season was shortened. Some have suggested that the fact MLB did not have a work stoppage has to do with the fact that baseball has no salary cap, allowing for more wiggle room in negotiations.

While the NHL lockout might not wipe out the whole season as the one in 2004-05 did, a sizeable chunk of games could be lost without productive talks soon.

In jeopardy are a couple of key items on the calendar: the New Year's Day outdoor Winter Classic at 115,000-seat Michigan Stadium between the host Detroit Red Wings and the Toronto Maple Leafs; and, the Jan. 27 All-Star game hosted by the Columbus Blue Jackets, one of the league's struggling small-market teams.

The sides traded proposals Wednesday, but neither new offer moved them closer to a deal. The lack of progress then made a lockout almost inevitable.

"I think it's fair to say there was no realistic expectation to avoid lockout as of developments on Wednesday and Thursday," Daly told the AP.

Bettman has insisted that hockey management is determined to come away with economic gains, even if it forces another work stoppage. Damage is certain to occur almost immediately, and there is no telling how jilted fans and sponsors will react to another shutdown, especially if it lasts through the fall and into the winter.

Players are concerned management hasn't addressed the league's financial problems by re-examining the teams' revenue-sharing formula. Having made several big concessions to reach a deal in 2005, the union doesn't think it should have to make more this time after record financial growth.

Bettman has repeatedly said that the NHL won't operate under the CBA that ended the previous lockout in July 2005. Once that lockout was imposed in September 2004, the sides didn't get back together again until December.

Players absorbed a salary-cap system and took an immediate 24 percent rollback of existing contracts in 2005 in exchange for 57 percent of hockey-related revenues. The NHL now says that figure is too high, and is willing to have another league shutdown to reduce that share to 49 percent to 47 percent.

Its original offer was to cut it to 43 percent, and an updated proposal raised it to 46 before another new offer pushed it a little higher Wednesday, the last time the sides met at the negotiating table.

The most recent proposal from the league ? with a six-year term ? came in direct response to one put forth by the union earlier Wednesday that was rejected as being similar to the players' two previous offers.

Instead of making a percentage-based offer, the union is seeking a deal that would guarantee players annually at least the $1.8 billion in salaries paid out last season.

Bettman said the league's latest offer would be pulled off the table once the current CBA expired because immediate damage caused by a lockout would force the NHL to reassess what it could then offer.

In the previous lockout, both sides dug in over the salary cap. Owners wouldn't make a deal without it, and players sacrificed a full season before finally agreeing to a cost-certainty system for teams.

Without such a philosophical difference this time, the sides merely have to figure out a way to divide hockey revenues that grew from $2.1 billion to $3.3 billion under the expiring deal.

On Friday, the Quebec labor relations board rejected a request from the players' association for a temporary injunction against a potential lockout in Quebec. But the board also ruled that more hearings are needed to make a final decision on a request by 16 members of the Montreal Canadiens and the players' association to declare a lockout illegal in the province. No date was set for those hearings.

With the ruling, Canadiens players will be locked out with their colleagues, at least for now.

Daly said in a statement the league was "extremely appreciative" of the decision.

"We are hopeful that this ruling will cause the players' association to cease pursuing these needless distractions and instead focus all of its efforts and energies on making progress at the bargaining table," he said.

Likewise, the union was "pleased" with the ruling because it rejected the NHL's request to dismiss the case.

"The ruling acknowledges that the players have raised issues about the legality of the NHL's planned lockout that require a full hearing on the merits," union general counsel Don Zavelo said in a statement.

"We remain confident that the lockout is prohibited by the Quebec labor code and look forward to presenting our case to the commission in the near future. Should the NHL carry out its threat to lock out the players in Quebec, it will do so at its own risk."

The NHLPA argued that because it isn't certified as a union with the province, its members can't be locked out under Quebec labor law.

A similar request was filed late Thursday with the Alberta labor relations board. NHLPA director of operations Alexandra Dagg said the aim was to prevent players from the Edmonton Oilers and Calgary Flames from being locked out.

In Alberta, the union will argue that proper labor negotiating procedure wasn't followed, including using a mediator.

The current contract was agreed to in 2005, and Bob Goodenow resigned as union head two weeks later. After stints by Ted Saskin and Paul Kelly, the union in 2010 turned to Donald Fehr, who led baseball players through three work stoppages in the 1980s and '90s.

Players struck in April 1992, causing 30 games to be postponed. This would be the third lockout under Bettman. The 1994-95 lockout ended after 103 days and the cancellation of 468 games.

The most recent lockout was finally settled in July 2005 ? 301 days into the work stoppage and a month after the league would usually have awarded the Stanley Cup. It marked the first time a North American professional sports league lost an entire season because of a labor dispute, and the first time the Stanley Cup wasn't handed out since 1919, when a flu epidemic caused no champion to be crowned.

Youngstown mayor wants to sell city's mineral rights to drillers

Date: Friday, September 14, 2012, 7:00am EDT

Youngstown Mayor Charles Sammarone wants to sell mineral rights on city-owned land to drillers.

Youngstown Mayor Charles Sammarone wants city council to give administrators permission to sell mineral rights on city-owned land to drillers who want to extract oil and natural gas from underground shale formations, the Vindicator in Youngstown reports.

Sammarone told the newspaper that the city would use the windfall from the sale to pay for demolition of 1,070 residences that need to come down and neighborhood improvement projects. That resolution will go before council next week.

Youngstown's council also is weighing a resolution that would urge "stringent regulation" from state regulators charged with overseeing drilling in Ohio, the newspaper reports.

Final version of Office for Windows RT to land in November

Microsoft has offered up some fresh details about the upcoming release of Office for Windows RT. In a post at the Office Next blog yesterday, the company re-confirmed that the tablet-focused productivity software optimized for ARM processors will come pre-installed on Windows RT devices at no extra cost, but it will be a preview version of Office Home & Student 2013 containing Word, Excel, PowerPoint and OneNote.

It?s unclear if this means Microsoft expects the software to be buggy and crash prone initially, or if some features will be missing. That said, all customers will eventually receive an upgrade to the final version of the suite for free via Windows Update starting in early November through January depending on their language.

Office Home & Student 2013 RT will only run in Windows RT machines and will not be sold as a stand-alone product. It was built from the same code base as the versions of Office for computers running traditional x86 chips from Intel and AMD, and offers "the vast majority" of the features available in the full PC version.

Microsoft says Windows RT tablets have special requirements for security, reliability, and battery life, thus some differences with x86 version are unavoidable. Here's the list of features missing for ARM users:

  • Macros, add-ins, and features that rely on ActiveX controls or 3rd party code such as the PowerPoint Slide Library ActiveX control and Flash Video Playback
  • Certain legacy features such as playing older media formats in PowerPoint (upgrade to modern formats and they will play) and editing equations written in Equation Editor 3.0, which was used in older versions of Office (viewing works fine)
  • Certain email sending features, since Windows RT does not support Outlook or other desktop mail applications (opening a mail app, such as the mail app that comes with Windows RT devices, and inserting your Office content works fine)
  • Creating a Data Model in Excel 2013 RT (PivotTables, QueryTables, Pivot Charts work fine)
  • Recording narrations in PowerPoint 2013 RT
  • Searching embedded audio/video files, recording audio/video notes, and importing from an attached scanner with OneNote 2013 RT (inserting audio/video notes or scanned images from another program works fine)

The company will disclose more details on October 26, the day Windows 8 and Windows RT officially debut.
